1. Acceptance of Terms
By accessing or using Back My Cloud ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Back My Cloud provides automated backup and recovery services for SaaS applications including Notion, Microsoft 365, Google Workspace, Jira, Slack, Confluence, and other supported platforms. The Service performs scheduled backups of your data and enables you to restore it when needed.
3. Account Registration
To use the Service, you must:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Be at least 16 years of age
- Have the authority to bind your organization to these Terms
- Notify us immediately of any unauthorized access to your account
4. SaaS Application Access
You grant Back My Cloud permission to:
- Access your connected SaaS applications using OAuth or API credentials you provide
- Read and store data from these applications for backup purposes
- Restore data to these applications when you request recovery
You represent that you have the necessary rights and permissions to authorize our access to these applications and their data.
5. Subscription and Payment
- Subscription Plans: The Service is offered on a subscription basis with various plan tiers
- Billing: Subscriptions are billed in advance on a monthly or annual basis
- Payment Methods: We accept major credit cards and other payment methods
- Automatic Renewal: Subscriptions automatically renew unless canceled before the renewal date
- Refunds: Refunds are provided at our discretion according to our refund policy
- Price Changes: We may modify pricing with 30 days' notice
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to store or back up illegal, harmful, or infringing content
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Resell or redistribute the Service without our written permission
7. Data and Backup Limitations
- Backup Frequency: Backups are performed daily according to your subscription plan
- Retention Period: Backups are retained for 30-90 days depending on your plan
- Storage Limits: Your plan includes specified storage limits; additional storage may incur extra charges
- Best Efforts: While we strive for 100% backup reliability, we cannot guarantee that all data will be captured in every backup
- Your Responsibility: The Service is a supplementary backup solution; you remain responsible for maintaining your own data security practices
8. Service Availability
We aim to provide 99.9% uptime but do not guarantee uninterrupted access. The Service may be unavailable due to:
- Scheduled maintenance (with advance notice when possible)
- Emergency maintenance or security updates
- Third-party service outages (SaaS providers, hosting infrastructure)
- Force majeure events beyond our control
9. Intellectual Property
- Your Data: You retain all rights to your backed-up data
- Our Service: Back My Cloud and its technology, including software, designs, and branding, are our intellectual property
- License: We grant you a limited, non-exclusive, non-transferable license to use the Service
10. Confidentiality
We treat your backed-up data as confidential and protect it according to our Privacy Policy. We will not access your data except:
- To provide the Service (perform backups, execute restores)
- To troubleshoot technical issues with your explicit permission
- When required by law or legal process
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAULTSTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Back My Cloud from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of third parties.
14. Termination
- By You: You may cancel your subscription at any time through your account settings
- By Us: We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity
- Effect of Termination: Upon termination, you will lose access to your backups after a grace period of 30 days
15. Data Protection and GDPR Compliance
We process your data in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy. Your data is stored in European datacenters and protected with industry-standard security measures.
16. Governing Law
These Terms are governed by the laws of the European Union and the jurisdiction where Back My Cloud is registered. Any disputes shall be resolved in the courts of that jurisdiction.
17. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
